Terms of Service

Terms governing use of pawmiva.store and purchases from Pawmiva

These Terms of Service (‘Terms’) are an agreement between you, doing business as Pawmiva (‘Pawmiva,’ ‘we,’ ‘us,’ or ‘our’). They govern your access to https://pawmiva.store/ (the ‘Site’) and your purchase or use of products and services offered through the Site. By using the Site or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Site or place an order.

1. Eligibility and authority

You must be at least 18 years old or the age of legal majority where you live to place an order. If you use the Site on behalf of a business or another person, you represent that you have authority to bind that party. The Site is intended for customers in the United States.

2. Store platform and third parties

Our store is hosted by Shopify. We may use third-party suppliers, fulfillment platforms, payment providers, fraud-prevention services, warehouses, carriers, analytics providers, and marketing services. Your use of a third-party service may also be governed by that provider’s terms and privacy practices. Pawmiva remains responsible for its own obligations to you under applicable law.

3. Product information

We make reasonable efforts to present product descriptions, dimensions, materials, compatibility, colors, images, and availability accurately. Screen settings, lighting, manufacturing updates, packaging changes, and normal production variation may create minor differences. Measurements may have reasonable tolerances. Such minor differences do not permit an undisclosed substitution or eliminate any right relating to a materially misdescribed product.

Pet sizes, breeds, coats, temperaments, and needs vary. You are responsible for reviewing dimensions, weight limits, materials, age guidance, and warnings and for choosing a product appropriate for your pet. Contact us before purchase if a material specification is unclear.

4. Prices, taxes, availability, and errors

Prices are shown in U.S. dollars unless stated otherwise. Taxes and shipping are calculated as shown at checkout. Product availability and prices may change before an order is accepted. Placing an order is an offer to purchase; an automated order confirmation acknowledges receipt but does not necessarily mean the order has been finally accepted or shipped.

If a product, price, discount, inventory level, shipping charge, description, or other material information contains an obvious error, Pawmiva may correct the error and, before shipment, cancel the affected order or ask whether you wish to proceed on corrected terms. If we cancel an order after payment, we will refund the amount charged for the canceled item. We will not substitute a materially different product without your consent.

5. Orders and verification

We may limit quantities, refuse or cancel orders, or request reasonable verification when necessary to address suspected fraud, unauthorized payment, resale activity, inventory error, shipping restrictions, sanctions or legal compliance, abusive conduct, or risk to customers, animals, or the business. Any refusal will be applied in a lawful, nondiscriminatory manner. If we cancel a paid order, we will issue the required refund.

6. Payment

You represent that the payment and billing information you provide is accurate and that you are authorized to use the payment method. You authorize Pawmiva and its payment providers to charge the total presented at checkout, including applicable taxes and disclosed shipping charges. Payment information is processed by payment providers; Pawmiva does not ordinarily receive or store your full card number.

7. Shipping, returns, and related policies

Our Shipping Policy, Return & Refund Policy, Order Cancellation & Modification Policy, and Lost, Stolen, Damaged, Missing & Delivered Packages Policy are incorporated into these Terms. If a conflict exists, the policy most specifically addressing the issue controls, except that non-waivable law always controls.

8. Pet safety and proper use

Products must be used only for their intended purpose and in accordance with all instructions, warnings, size limits, and manufacturer guidance. Supervise pets when appropriate; inspect products before and during use; keep small parts, packaging, sharp edges, cords, tools, chemicals, and damaged products away from pets and children; and discontinue use if a product becomes worn, loose, broken, or unsafe.

Pawmiva content is general product information, not veterinary, medical, behavioral, or professional advice. Consult a qualified veterinarian or other professional regarding a pet’s health, injury, allergies, behavior, or suitability for a product. In an emergency, contact an emergency veterinarian or appropriate emergency service immediately.

9. Warranties and legal rights

A product may include a written manufacturer warranty described on its product page or packaging. Unless Pawmiva expressly provides a separate written warranty, Pawmiva does not create an additional express warranty beyond the product description and rights provided by law.

Nothing in these Terms excludes, disclaims, or modifies an implied warranty, remedy, or consumer right that cannot be excluded, disclaimed, or modified under applicable law. In particular, any disclaimer that is unenforceable for Massachusetts consumer goods will not apply.

10. Intellectual property

The Site and its original text, branding, graphics, layout, photographs, videos, software, and other content are owned by or licensed to Pawmiva and are protected by applicable intellectual-property laws. You may use the Site for personal, noncommercial shopping purposes. You may not copy, scrape, reproduce, distribute, sell, reverse engineer, remove rights notices from, or commercially exploit Site content without permission, except as allowed by law.

11. Accounts and security

If account features are offered, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend an account where reasonably necessary to protect the customer, Pawmiva, or others.

12. Acceptable use

You may not use the Site to violate law; infringe rights; transmit malicious code; bypass security or access controls; harvest personal information; interfere with Site operation; place fraudulent orders; impersonate another person; submit deceptive reviews; abuse promotions; or threaten, harass, or harm another person. We may restrict access or cancel affected transactions when reasonably necessary to address such conduct.

13. Reviews and user content

If you submit a review, photo, video, comment, or other content, you represent that it is truthful, based on your genuine experience where stated, and that you have the right to submit it. The Reviews, Photos & User-Generated Content Policy applies and is incorporated here.

14. Third-party links

The Site may link to third-party websites or services. A link does not necessarily mean Pawmiva endorses that third party. We are not responsible for third-party content or practices, but nothing here limits responsibility that applicable law places on Pawmiva.

15. Limitation of liability

To the fullest extent permitted by law, Pawmiva will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Site or a product, including lost profits or lost data, when such damages were not reasonably foreseeable or when the law permits their exclusion. To the fullest extent permitted by law, Pawmiva’s aggregate liability for a claim relating to a specific product or order will not exceed the amount you paid Pawmiva for that product or order.

These limits do not apply where prohibited by law and do not exclude liability for fraud, willful misconduct, gross negligence, personal injury caused by legally actionable conduct, or any warranty, remedy, or consumer right that cannot be limited.

16. Indemnity for misuse

To the extent permitted by law, you agree to reimburse Pawmiva for reasonable losses and third-party claims directly caused by your unlawful use of the Site, fraudulent activity, infringement of another person’s rights, or material breach of these Terms. This provision does not require you to indemnify Pawmiva for Pawmiva’s own negligence, unlawful conduct, or breach of duty.

17. Informal dispute resolution

Before filing a lawsuit or arbitration, you and Pawmiva agree to make a good-faith effort to resolve the dispute for at least 30 days. Send a written notice to support@pawmiva.store and describing your name, order number, the facts, the relief requested, and how to contact you. Pawmiva will send its notice to the contact information associated with your order. This requirement does not prevent either party from seeking urgent injunctive relief or using a small-claims court where eligible.

18. Binding individual arbitration; small-claims exception; opt-out

PLEASE READ THIS SECTION CAREFULLY. WHERE PERMITTED BY LAW, ANY DISPUTE NOT RESOLVED THROUGH THE INFORMAL PROCESS WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS APPLICABLE CONSUMER ARBITRATION RULES, RATHER THAN IN COURT. The Federal Arbitration Act governs this section. Arbitration may be conducted by documents, telephone, video, or in person as the rules permit. Pawmiva will pay arbitration fees it is required to pay under those rules. The arbitrator may award the same individual remedies a court could award and must follow these Terms and applicable law.

Either party may bring an eligible individual claim in small-claims court instead of arbitration. Nothing here prevents a customer from contacting a government agency or exercising a right that cannot be waived.

You may opt out of this arbitration section by emailing support@pawmiva.store within 30 days after your first purchase or first acceptance of these Terms, whichever is earlier. Your notice must include your full name, order number or account email, mailing address, and a clear statement that you opt out of arbitration. Opting out will not affect your order or other Terms.

19. No class proceedings

WHERE PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may award relief only to the individual seeking relief and only to the extent necessary to resolve that individual claim. If this paragraph is found unenforceable for a particular claim or remedy, that claim or remedy will proceed in a court of competent jurisdiction after any arbitrable issues are completed, unless applicable law requires otherwise.

20. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, and by applicable federal law. If a dispute is not subject to arbitration or eligible small-claims proceedings, the parties consent to the state or federal courts located in Massachusetts, unless mandatory consumer law requires another forum. This choice does not deprive you of non-waivable protections of the state where you reside.

21. Changes, severability, and entire agreement

We may update these Terms prospectively to reflect legal, operational, or service changes. The updated version will be posted with a revised date. Material changes will not retroactively reduce rights relating to an order already placed unless allowed by law and agreed where required. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. These Terms and incorporated policies are the entire agreement concerning the Site and purchases, except for any additional written terms that expressly apply.
